got the insurance paper yesterday saying my car is a total,
went looked at the car today, here is some pix

quick question. there is a giant dent on the passenger rear side, which have almost no scratches, is that because someone actually hit me or because i hit the wall and it dented in? the girl who hit me was driving a Nissan truck and the height is about right where the dent is. also isn't that dent too clean of a hit if i hit the wall and somehow made a dent like that?

the head hit the wall first btw.

Don't know buddy, but that looks like the insurance company is gonna total that bad boy, hopefully I"m wrong. How the hell did you knock out the front and rear? and why aren't you wearing a neck brace and hiring a lawyer to sue her ass anyway???

I got extremely lucky since there was no cars coming up from my left. the car is already been listed as total because it's a unibody car, it's going to cost a lot more to repair just the body, but the car is still driveable. She hit me at 70mph on the high way, and the car spin out and ran into the wall.

I think lawyer is already called, tbh if she just took the time to stop and make sure I was alright i'd prob drop the law sue thing. I was all dressed up because i had a interview, but when the air bag deployed, i don't even think it even hit me but my nose started bleeding NON STOP.

I am in school right now but my parents is on their way to pick up the police report at the metro PD, so i should know with in the hr worst comes to worst next hr or two

It dosn't take much to total a car these days. With parts and labor so high the insurance company would rather give you book value than repair it.

Thanks guys, unfortunately because there was no mark left on the other car the insurance company pretty much said it's my own fault. Lawyer is called, and they are going to look into it. there is ONE witness, which was the one who filed the police report with me.
my fingers are crossed.

if there is a witness that saw it in another car the lawyer should get everything taken care of

well since the car is only worth 4k or so, the lawyer told us unless i have injury there is no point of filing anything atm, because the fees is gonna be around if not more than that.

I'd let this ride and see if something does come up they can use.
If the witness can validate your side of the story and also validate the driver of the other vehicle didn't even care to stop and check on you, that could very well help since that would prove the other driver was careless/neglegent.

Some states (Bama does) have what's called a "Good Samaritan" law and you can be charged and thrown in jail if by you, by doing nothing to render aid/assistance to someone is proven to be a contributing cause of someone's death or contributes to the worsening of their condition.

What I'm saying is her lack of concern for your well-being, esp if it can be proven she was aware of what happened in the first place (And I'm sure it could be with ease) won't make her look any better.
It's a "Care or Care-less" thing.

Go to your doctor, tell him/her that your neck hurts so bad you can't turn your head (maybe stop at Walgreen's first and buy a neck brace). Also, your back is in such terrible pain you cannot sleep at night or go to school at work. Get her to write this all down for you and give you the appropriate scripts, then..

go find yourself a good (read shyster) lawyer who works on commission and sue the bastard that did this to you!!!

Rmember, neither x-rays nor MRIs can prove or disprove back pain, play it right and you're stinkin rich :laughing:
